Rule 40
Conservation Private Forestry Arrangements

(1) The landowner within the conservation area may develop, protect and manage the private forest and use the forest produce under the management plan of the conservation area.
(2) In accordance with this rule, the Council may provide the necessary technical assistance to the owner of the private forest to develop, protect and manage the private forest.
(3) The owner of the protected private forest has the right to transport and sell the forest produce of that forest to be used within the protected area.
(4) Regardless of what is written in sub-rule (3), if the owner of the forest produce of the protected private forest has to take it outside the protected area and distribute it for sale, he shall submit an application to the Council with the recommendation of the relevant committee to reveal the type, type and quantity of the forest produce.
(5) If the application as per sub-rule (4) is received, the council shall carry out the necessary investigation and if such forest produce is found to belong to the owner of the private forest, the type, type and quantity of the forest produce shall be marked in the case of open wood and the council shall give permission to take it out of the conservation area in accordance with schedule-11. But no exemption will be given to export wood outside Nepal.
